Since all these criminal petitions, under Section 438 Cr.P.C. for grant of pre-arrest bail, arise out of the same crime in which the petitioners herein are arrayed as accused, they are heard together and are being disposed of by this common order.

Criminal Petition No. 6176 of 2023 is filed by accused No. 10; $\overline{2}$ . Criminal Petition No. 6738 of 2023 is filed by accused Nos. 72 and 74; Criminal Petition No. 7051 of 2023 is filed by accused Nos. 44 to 46, 51, 52, 54, 58, 64 to 71, 94, 98 to 102, 105 to 111, 115, 121, 133, 135 to 137, 142 to 157; Criminal Petition No. 7196 of 2023 is filed by accused Nos. 21, 24 to 43, 47, 48, 50, 53, 55 to 57, 59 to 63, 77 to 85, 87 to 93, 95 to 97, 103, 104, 112 to 114, 116 to 119, 122 to 132, 134 and 138 to 141 and Criminal Petition No. 7341 of 2023 is filed by accused No. 7 in crime No. 75 of 2023 of Mudiveedu Police Station, Annamayya District, registered for the

offences punishable under Sections 120-B, 143, 341, 324, 307 and 506 read with Section 149 IPC.

Heard Sri Posani Venkateswarlu, learned senior counsel, $3.$ representing Sri D.Purna Chandra Reddy, learned counsel appearing for the petitioners in Criminal Petition Nos. 6176 and 6738 of 2023, and Sri N.V.Sumanth, learned counsel appearing for the petitioners in Criminal Petition Nos. 7051, 7196 and 7341 of 2023, and learned Additional Advocate General appearing for the respondent-State.

Case of the prosecution in brief is that on 04-08-2023 while $4.$ de facto complainant was proceeding on his two-wheeler towards Madanapalle from Jallavandlapalle to buy medicines for his children and when he reached near Angallu Village, he found a mob of persons with Telugu Desam Party flags and scarves and while he was proceeding slowly by the side of road, some of those persons obstructed him and raised cries to kill him as he appears to be supporter of YSR Congress Party and thereupon, he was beaten by stones, iron rods and sticks, due to which he received bleeding

On the basis of the report lodged by de facto injuries. complainant, the present crime has been registered.

Sri Posani Venkateswarlu, learned senior counsel, would submit that the petitioners have not committed any offence much less the offences alleged and it is only a false case foisted against them on account of political rivalry; that no allegations have been made against the accused herein except against accused Nos. 7 and 10 and the alleged overtacts attributed to accused Nos. 7 and 10 do not attract the offence under Section 307 IPC and that the injuries said to have been sustained by de facto complainant in the alleged incident are simple in nature and therefore requests this Court to grant anticipatory bail to the petitioners.

  2. Learned Additional Advocate General, on the other hand, vehemently opposed the criminal petitions on the ground that series of attacks were made by the persons belonging to Telugu Desam Party on the fateful day.

  3. This Court perused the entire material available on record. As can be seen from the report lodged by de facto complainant, no specific overtact has been attributed to the accused herein except

accused Nos. 7 and 10. As the offences alleged are not serious in nature except the offence under Section 307 IPC and as the injuries sustained by de facto complainant are simple in nature, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions.

The petitioners-accused Nos. 7, 10, 21, 24 to 48, 50 to 72, 8. 74, 77 to 85, 87 to 119 and 121 to 157 are, therefore, directed to surrender before the Station House Officer, Mudiveedu Police Station, Annamayya District, within a period of two weeks from today. On such surrender, the petitioners-accused Nos. 7, 10, 21, 24 to 48, 50 to 72, 74, 77 to 85, 87 to 119 and 121 to 157 are ordered to be enlarged on bail on their executing each a personal bond for Rs.10,000/- with two sureties for the like sum each to the satisfaction of the Station House Officer, Mudiveedu Police Station. After release, the petitioners-accused Nos. 7, 10, 21, 24 to 48, 50 to 72, 74, 77 to 85, 87 to 119 and 121 to 157 are directed to appear before the Station House Officer, Piler Police Station, on every Monday between 10 a.m. and 1 p.m. for a period of two

weeks and also directed to cooperate with the investigating agency and not to tamper with the prosecution witnesses.

  1. Accordingly, all the criminal petitions are allowed. Pending miscellaneous applications, if any, shall stand disposed of in consequence.
