IN THE HIGH COURT OF ANDHRA PRADESH :: AMARAVATI THE HON'BLE SRI JUSTICE NINALA JAYASURYA WRIT PETITION NO.24723 of 2023
Between:-
Garikamukku Vijaya Raju & 19 others …. Petitioners And The State of Andhra Pradesh, represented by its Principal Secretary, Revenue Department & 6 others …. Respondents Counsel for the Petitioner : M/s. Matta Lokanadham Counsel for the Respondents : Learned Government Pleader for Revenue
ORDER:
Heard the Learned Counsel for the petitioners. Also heard the Learned Assistant Government Pleader for Revenue. With their consent, the Writ Petition is disposed of, at the stage of admission.
-
The present Writ Petition is filed seeking to declare the action of the respondents in restraining to issue new Pattas in respect of the petitioners in respect of their lands, as illegal, arbitrary etc., and for a consequential direction to the respondents not to create any disturbances in the life of petitioners, to direct the respondents 3 to 7 not to take any steps against the petitioners' land, not to alienate the petitioners' land to others and to pass such others.
-
The Learned Counsel for the petitioners with reference to the averments made in the Affidavit in support of the Writ Petition and the material filed along with the same sought to advance detailed arguments. However, in the light of the instructions dated 21.9.2023 submitted by the 4th respondent for perusal of this Court, the matter need not be examined in detail. In the said instructions, it is inter alia stated as follows:-
"….. The contention of the writ petitioners that the 6 th and 7 th respondents are trying to cancel their pattas with the support of the Respondents 3, 4 and 5 is not at all correct. Even there is no proposal of acquiring the said lands for any purposes of the Government and that the dispossession of the writ petitioners from their lands does not arise and it is only an apprehension of the writ petitioners."
- In view of the same, the Writ Petition is disposed of, granting liberty to the petitioners to seek resource to Law, if any fresh cause of action arises. There shall be no order as to costs. As a sequel, pending applications, if any, shall stand closed.
