The above writ petition is filed to declare the action of the respondents 5 and 6 in preventing the petitioner from discharging his duties as Field Assistant in Nidiguntapalem Gram Panchayat of Venkatachalam Mandal, SPSR Nellore District as illegal and arbitrary.
- Heard Sri V.Roopesh Kumar Reddy, learned counsel for the petitioner, Sri R.S. Manidhar Pingali, learned Assistant Government Pleader for Services '-for respondent No.1; Sri M.S.R. Chandra Murthy, learned Standing counsel for
respondents 2 to 4 and 6 and Smt B.Aparna Lakshmi, learned Standing counsel for respondent 5.
Learned counsel for the petitioner would submit that the petitioner was $3.$ appointed as Field Assistant in Nidiguntapalem Gram Panchayat of Venkatachalam Mandal, SPSR Nellore District on 25.05.2023. He would submit that without passing any order or without issuing any notice, the respondents 5 and 6 are interfering with the petitioner's discharging duty as Field Assistant.
Sri M.S.R. Chandra Murthy, learned Standing counsel, would submit $4.$ that neither respondent No.5 nor respondent No.6 is interfering with the petitioner discharging duty as Field Assistant. He also submitted instructions furnished by Mandal Parishad Development Officer, Venkatachalam, wherein it was stated that petitioner was absconded to duties without prior permission from the authorities. Learned Standing counsel would further submit that if the petitioner attends the duty, the respondents 5 and 6 will not object.
$5.$ Copy of instructions is placed on record.
Given the facts and circumstances of the case coupled with the 6. Mandal Parishad Development Officer. instructions furnished by Venkatachalam, the writ petition is disposed of, at the admission stage with the consent of learned counsel on either side, directing the respondents 5 and 6 not to prevent the petitioner from discharging duty as Field Assistant in Nidiguntapalem Gram Panchayat of Venkatachalam Mandal, SPSR Nellore District, without following due process. No costs.
Miscellaneous petitions pending, if any, shall stand closed.
