THE HON'BLE SRI JUSTICE RAVI NATH TILHARI

Contempt Case No.2058 of 2021

in

WRIT PETITION No.18897 of 2020

JUDGMENT:-

  1. Heard Sri V.S.K.Rama Rao, learned counsel for the petitioner and M.V.Krishna Rao, learned counsel for the respondents.

  2. Sri N.Satish Kumar, Executive Officer, Sri Abhaya Anjaneya Swamy Temple, Appanaveedu Village, Pedapadu Mandal, West Godavari District, the respondent herein, is present in person. On 10.03.2022, he had given undertaking that the amount recovered from the petitioner pursuant to the order, dated 19.07.2021, shall be refunded to the petitioner positively by 24.03.2022.

  3. A memo vide U.S.R.No.14023 of 2022 has been filed annexing therein the copy of bank challan, dated 22.03.2022 and copy of Lr.No.14/2022, dated 22.03.2022 along with its translation to show that he has complied with the undertaking given on 10.03.2022 and the amount has been refunded in the account of the petitioner.

  4. Sri V.S.K. Rama Rao, learned counsel for the petitioner submits that the amount has been received by the petitioner in the bank account.

  5. In the counter affidavit already filed, the respondent submitted that due to his misunderstanding of the interim order, the amount was recovered from the petitioner, as he was under bonafide belief that the said recovery proceedings were not covered by the interim order. For such mistake on his part, the respondent had also tendered unconditional apology.

  6. Considering the aforesaid, the unconditional apology is accepted. This matter need not be proceeded any further and the Contempt Case is accordingly brought to an end.

As a sequel thereto, miscellaneous petitions, if any pending, shall also stand closed.

It is however clarified that the aforesaid refund shall abide by the result of the writ petition.
