THE HON'BLE SRI JUSTICE M. GANGA RAO

Contempt Case No.2039 of 2021

ORDER:

This contempt case is filed complaining non-implementation of the orders of this Court passed in IA.No.2 of 2020 in WP.No.10282 of 2020 dated 20.08.2020.

Pursuant to the Form-I notice, respondents 1 & 2 appeared in person.

Learned counsel appearing for the respondents submits that the respondents 1 & 2 have filed their reply affidavits and that the 2nd respondent also filed a report dated 15.03.2022.

In the report, at paragraph No.4, it is specifically stated that by implementing the orders of this Court, the poultry farm belonging to the respondent No.9 in the writ petition has been closed vide panchanama dated 11.03.2022.

The same is not disputed by the learned counsel for the petitioner and states that recording the same, the contempt case can be closed.

Insofar as the delay that occurred in implementing the orders of this Court is concerned, it is stated in the reply affidavits filed by the respondents that immediately after receipt of the orders of this Court, the Tahsildar, Pamidmukkala, has issued notice to the 9th respondent in the writ petition under Section 133 Cr.P.C on 26.04.2021 and further issued orders under Section 138 Cr.P.C on 29.11.2021 directing the 9th respondent to vacate poultry farm, within six days. Aggrieved by the orders passed under Section 138 Cr.P.C, the 9 th respondent filed WP.No.28665 of 2021 and obtained interim order dated 03.12.2021 whereby the respondents were directed not to take any coercive steps with regard to the poultry farm of the petitioner, till 09.12.2021. In the said circumstances, the delay had occasioned. There is no willful or deliberate violation of the orders of this Court.

Considering the submissions made by the learned counsels for the petitioner and the respondents and on perusal of the material record, this Court found that the respondents have not violated the orders of this Court much less willfully and deliberately.

Accordingly, recording the aforesaid submissions, the Contempt Case is closed. No order as to costs.

As a sequel, pending miscellaneous applications, if any, shall stand closed.
