THE HON'BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION No.24216 of 2023
ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue the Writ, order or Direction more particularly in the nature of Writ of Mandamus declaring the action of the Respondent Nos.4 to 6, who failed to consider the representation of the petitioner, dated 23.08.2023 for transferring the petitioner to the SVA Government Degree College (Men), Srikalahasti, Tirupati District under the request transfer as per proceedings of the Respondent No.2 bearing Rc.No.11/Ser.I-B/2023, dated 14.08.2023 of Annexure-I bearing Guidelines-H as illegal, arbitrary and against the principles of natural Justice and violation of Article 19(1)(e) and 21 of the Constitution of India and consequently direct the Respondent authorities to consider the representation of the petitioner dated 23.08.2023 for transferring the petitioner to the SVA Government Degree College (Men), Srikalahasti, Tirupati District, under Spouse Cases and to pass such other order or orders ….."

Heard learned counsel for the petitioner, learned Government Pleader for Services-III appearing for the respondents.

Learned counsel for the petitioner submits that suffice if a direction is given to respondent authorities, more particularly, to respondent Nos. 4 to 6 to consider the representation dated 23.08.2023 submitted by the petitioner to the 7th respondent requesting for transfer to SVA Government Degree College (Men), Srikalahasti, Tirupathi District from the Government Degree College, Koduru (RS), Annamayya District under Spouse grounds

Learned Government Pleader appearing for the respondents would submit that the representation dated 23.08.2023 submitted by the petitioner would be considered by the respondent authorities in accordance with law, within a reasonable time.

Having regard to the submissions made by learned counsel for the petitioner and learned Government Pleader for Services-III, in view of the facts and circumstances of the case, on perusal of the material placed before this Court, without touching merits of the case, this Court is of the considered view that the present Writ Petition can be disposed of directing respondent Nos. 4 to 6/ District Committee to consider and dispose of the petitioner's representation dated 23.08.2023 and pass appropriate orders within a period of four (04) weeks from the date of receipt of a copy of this order.

- With the above said direction, the Writ Petition is disposed of. There shall be no order as to costs.
Consequently, Miscellaneous Petitions, if any, pending in the writ petition shall stand closed.
