THE HON'BLE Dr.JUSTICE K. MANMADHA RAO Writ Petition No.28400 of 2022

ORDER:-

This Writ Petition is filed, under Article 226 of the Constitution of India, seeking to declare the action of the respondents with regard to non-payment of minimum pay scale to the petitioners attached to the post of Shift Operators, Pole to Pole workers in the category of Junior Lineman, even though the petitioners are discharging the same duties as that of Junior Lineman, as illegal and arbitrary; consequently directing the respondents to pay minimum scale of pay to the petitioners as per the law laid down by the Hon'ble Supreme Court in the case of State of Punjab and others v. Jagjit Singh and others reported in 2017 (1) SCC 148.

  1. Heard Mr. Sudhakar Reddy Pasapala, learned counsel for the petitioners and Mr. V.R. Reddy Kovvuri, learned Standing Counsel for respondent No.2 and Mr. Anup Koushik Karvadi, learned Standing Counsel for respondent No.3. Perused the material available on record.

Learned Counsel for the petitioners submits that the petitioners gave a representation dated 27.07.2022 to the 1st respondent and he in turn forwarded the same to the Chairman and Managing Director, APTRANSCO, Vijayawada / 3rd respondent, vide Letter dated 27.07.2022. Learned counsel for the petitioners further submits that suffice if a direction is given to the 3rd respondent to dispose of the above said representation, following the law laid down by the Hon'ble Supreme Court in the case of State of Punjab and others v. Jagjit Singh and others<sup>1</sup> for payment minimum pay scale to the petitioners, by stipulating the time period.

  1. Learned Standing Counsel for the respondents 2 and 3 does not refute the said submission.

  2. Having regard to the facts and circumstances and without touching the merits of the case, the 3 rd respondent is directed to consider and pass appropriate orders on the representation dated 27.07.2022 of the petitioners, following the law laid down by the Hon'ble Supreme Court in the case of State of Punjab and others v. Jagjit Singh and others cited supra, for payment minimum pay scale to the petitioners, within a period of (08) eight weeks from the date of receipt of the order.

  3. Accordingly, the writ petition is disposed of at the admission stage. No costs.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
