Petition under Section 151 CPC is filed praying that in the circumstances stated in the affidavit filed in support of the writ petition, the High Court may be pleased to direct the respondents to release undisputed final bill amount of Rs.1,09,978/- to the petitioner including interest for the work "Desilting of foreshore tank, bund strengthening of Ramalingareddy tank near Motichintalapalem Village in Vinjamur Mandal of SPSR Nellore District" executed under Neeru-Chettu Programme in pursuance of the agreement entered into with the 5th respondent vide Agreement No. 143/2017-18, pending disposal of WP No. 28116 of 2021, on the file of the High Court.

The court while directing issue of notice to the Respondents herein to show cause as to why this application should not be complied with, made the following order. (The receipt of this order will be deemed to be the receipt of notice in the case).

ORDER:

Upon hearing learned counsel for the petitioner and learned Government Pleader for irrigation, having regard to the averments in the affidavit filed in support of the writ petition, finding that the measurements were taken and recorded in MBook leading to finalization of the bills, since the amount is not paid to the petitioner, there shall be an interim direction whereby respondents are directed to clear the bills presented by the petitioner and release Rs.1,09,978/within four weeks from today. In default, this amount shall carry interest at 9% per annum.
