Learned counsel for the petitioner rightly | |||
points<br>out that the CCLA and District Collector | |||
have passed orders<br>earlier for formally<br>handing | |||
over the<br>alternate land to the writ petitioner on | |||
exchange basis.<br>He refers to<br>the<br>memo of the | |||
special<br>Chief<br>Secretary<br>to<br>the<br>Government | |||
dated<br>08.02.2019<br>wherein<br>the<br>Government | |||
"accorded<br>permission<br>to<br>hand<br>over<br>the | |||
alternate<br>land". He also points<br>out<br>a<br>memo | |||
dated 25.07.2019 which<br>is from the office of | |||
the Spl.C.S.,<br>Revenue which also clearly states | |||
permission<br>was<br>accorded<br>to<br>handover<br>the | |||
alternate<br>land to<br>an extent of Ac.4.76 cents<br>to | |||
the petitioner. It also gives a further direction | |||
to make necessary changes in favour of the | |||
petitioner<br>in<br>the<br>revenue<br>records<br>also. | |||
Therefore, the learned counsel points<br>out that | |||
despite orders being passed on<br>the very same |

history<br>of<br>the<br>litigation<br>and<br>that<br>the<br>fact | |||
quietus<br>is achieved despite the passage of 14 | |||
years,<br>a<br>final direction is given to respondent | |||
No.1<br>to<br>ensure<br>that<br>the<br>orders<br>of<br>the | |||
Government<br>given in<br>the memos<br>earlier are | |||
complied with<br>in<br>letter and spirit within the | |||
next 15 days. | |||
Needless to mention,<br>if the orders<br>are | |||
not complied with, this Court will have to | |||
exercise its power in<br>summoning the officers | |||
for giving their personal explanation for the | |||
delay,<br>despite the earlier orders<br>on the subject. | |||
In<br>fact,<br>submissions<br>made<br>by<br>the | |||
learned counsel for the petitioner<br>are<br>that once | |||
the officers<br>of<br>the rank of the secretary<br>and<br>at | |||
the<br>highest<br>level<br>of<br>the<br>Government<br>have | |||
passed<br>orders<br>and<br>necessary<br>direction, | |||
correspondence<br>should not be entertained<br>and | |||
the matter should not be<br>delayed.<br>It is<br>hoped, | |||
that this direction would be complied in letter | |||
and spirit. | |||
