THE HON'BLE SRI JUSTICE RAVI CHEEMALAPATI

WRIT PETITION No.23563 of 2023

ORDER:

This Writ Petition is filed by the petitioner, under Article 226

of the Constitution of India, seeking the following relief:

"….to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents no.2 to 6 in not paying the petitioner Rs.13,49,434/- (Rupees thirteen lakhs forty nine thousand four hundred and thirty four only) towards works entrusted in favour of the petitioner and executed by the petitioner towards construction of administrative building for State Depot at 6th battalion, Mangalagiri, even after lapse of one (1) year from the date of entry in the measurement books after completion of the said work, as arbitrary, illegal and consequently direct the respondents to pay the petitioner Rs.13,49,434/- (Rupees thirteen lakhs forty nine thousand four hundred and thirty four only) towards works entrusted in favour of the petitioner and executed by the petitioner towards construction of administrative building for State Depot at 6th battalion, Mangalagiri and to pass such other order or orders…."

Heard Sri B.Abhay Siddhanth, learned counsel for the petitioner, learned Assistant Government Pleader for Social Welfare appearing for respondent No.1, learned Assistant Government Pleader for Finance appearing for respondent no.2 and learned standing counsel appearing for respondent nos.3 to 5.

  2. Learned Assistant Government Pleader for Finance and Planning Department, on written instructions which is placed on record, submitted that, the petitioner's bill is pending and it would be cleared on priority basis after due verification, however sought eight (8) weeks time for payment.

  3. To the said submission, learned counsel for the petitioner reported no objection.

  4. In view of the above, as the respondent authorities intend to pay the amount to the petitioner towards the work done by him within a period of eight (8) weeks, this Writ Petition is disposed of, at admission stage itself, with the consent of learned counsel for both the parties.

  5. Accordingly, the respondent authorities are directed to release the admitted/legally entitled amount to the petitioner at the earliest, and at any rate, within a period of eight (8) weeks from the date of receipt of a copy of this order.

  6. With the above directions, the writ petition is disposed of. There shall be no order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
