THE HON'BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION No.23084 of 2023

ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue an appropriate Writ, Order or Direction more particularly one in the nature of writ of Mandamus declaring the action of the Respondents in not entertaining the petitioner's application dt.26.12.2022 on the ground age bar in view of Notification No.05/2022 dated 01.12.2022 for the Post of the Staff Nurse on Contract as illegal, arbitrary and unconstitutional and consequentially direct the Respondents to include the petitioner's name in the merit list for the post of Staff Nurse on Contract forthwith and pass such other order or orders ….."

  1. Heard learned counsel for the petitioner and learned Government Pleader for Services-IV appearing for the respondents.

Learned counsel for the petitioner submits that suffice if a direction is given to respondent authorities, more particularly, to the 3rd respondent to consider the representation dated 30.08.2023 submitted by the petitioner requesting the respondents to include her name in the merit list for the post of Staff Nurse on Contract basis.

  3. Learned Government Pleader for Services-IV appearing for the respondents would submit that the representation dated 30.08.2023 submitted by the petitioner is not acknowledged by the respondents and let there be a direction to the petitioner to submit a fresh representation ventilating her grievance. On receipt of such representation, the respondent authorities would consider the same in accordance with law, within a reasonable time.

Having regard to the submissions made by learned counsel for the petitioner, learned Government Pleader for the respondents, in view of the facts and circumstances of the case, without touching merits of the case, this Court is of the considered view that the present Writ Petition can be disposed of, directing the petitioner to submit representation afresh to the 3rd respondent ventilating her grievance within a period of two (02) weeks from today. On receipt of such representation, the respondent authorities, more particularly, the 3rd

respondent shall consider the same and pass appropriate orders within a period of four (04) weeks, thereafter.

  1. With the above said directions, the Writ Petition is disposed of. There shall be no order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in the writ petition shall stand closed.
