Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ of Mandamus or any other appropriate writ, order or direction declaring the action of the 2^nd Respondent in issuing proceedings dated 07-07-2022 confirming in listing the property in prohibitory list under Sec. 22A of Registration Act against survey No. 938 situated at Atmakur Panchayath village and Mandal, Kurnool District as illegal, arbitrary, without jurisdiction and violative of principles of natural justice and consequently direct the respondents to delete to an extent of 484 square vards of the petitioners from prohibitory list

Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondent No. 5 to receive sale proceedings to an extent of 484 square yards in respect of the petitioners to the extent of 242 square yards each in Plot No. 9 in survey No. 938 situated at Atmakur Panchayath village and Mandal, Kurnool District, pending disposal of WP 26578 of 2021, on the file of the High Court.

The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and upon hearing the arguments of SRI THOTA RAMAKOTESWARA RAO Advocate for the Petitioners, and of GP FOR REVENUE for the Respondent No.1, 3, 4, 6, GP FOR ENDOWMENTS for Respondent No.2, GP FOR STAMPS AND REGISTRATION for Respondent No.5, the Court made the following.

ORDER:

"Despite granting time more than five (5) occasion from November 2021 phwards, the respondents have not chosen to file counter.

Hence, post after two (2) weeks finally.

If the 2^nd respondent have not filed the counter, he shall appear along with the records by next date of hearing".
