THE HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI Writ Petition No.20937 of 2019

Order:

This Writ Petition is filed to declare the action of the respondents, in not considering the request of the petitioner for transfer/relocation from ICTC, Munchingiput to ICTC Kotavuratla, in Visakhapatnam District, in the clear existing vacancy by considering his representations as illegal, arbitrary.

The case of the petitioner is that, he joined the service as Counselor on 17.11.2010 at ICTC (Integrated Counseling and Testing Centre) Upgraded PHC, Munchigput, Visakhapatnam District, as per proceedings, dated 08.11.2010, which is under the control of Project Director, APSACS ; in the year 2012, the A.P.State AIDS Control Society has conducted a counseling to consider the request transfers and re-allotment of counselors and petitioner submitted several representations to the 2nd respondent for transfer/relocation, on his personal grounds, to ICTC, Kotavuratla, where a clear vacancy exists, which is 30 k.m., away from the petitioner's residence; the 2nd respondent forwarded the same to the 1st respondent for necessary action; whereas the request of one M.Aravinda Kumar working as counselor like the petitioner was considered in the year 2019 and posted at CHC Dharmavaram, Ananthapur District from ICTC Government Hospital, Kadiri; but the 1st respondent did not consider the representation of the petitioner since 2013 onwards; hence the writ petition.

Learned Government Pleader for Medical and Health, appearing for the respondent Nos.1 to 3 submits that the 1st respondent would dispose of the representation of the petitioner and pass appropriate orders in accordance with law.

In the facts and circumstances of the case, without going into the merits of the case, the first respondent is directed to dispose of the representation of the petitioner, if it is pending before him, strictly in accordance with law, as expeditiously as possible, preferably, within a period of eight(8) weeks from the date of receipt of a copy of this order.

Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
