Petition under Section 482 of Cr.P.C, praying that in the circumstances stated in the memorandum of grounds filed in Criminal Petition, the High Court may be pleased to quash the proceedings in Crime No.269 of 2021, on the file of the Kundurpi Police Station, Anantapur District, dated 23.10.2021 against the petitioner.

The petition coming on for hearing, upon perusing the Petition and the memorandum of grounds filed in support thereof and upon hearing the arguments of Sri M Karibasaiah, Advocate for the Petitioner and the Asst. Public Prosecutor for the Respondent, the Court made the following; ORDER:

THE HON'BLE SRI JUSTICE D. RAMESH CRIMINAL PETITION No.6169 of 2021

ORDER:-

This Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") is filed seeking quash of F.I.R in Crime No.269 of 2021 of Kundurpi Police Station, Ananthapur District, registered for the offences punishable under Sections 270, 273, 328 of Indian Penal Code.

Heard learned counsel for the petitioner and the learned Additional Public Prosecutor for the State.

Learned counsel for the petitioner would submit that this is a covered matter in view of the earlier common order passed by this Court in Criminal Petition No.5421 of 2019 and batch, whereby this Court has quashed the F.I.Rs registered for the similar offences based on identical facts. Therefore, he would submit that the petitioner, who is similarly placed, is also entitled for quash of F.I.R. So, he would pray for quash of the F.I.R registered against the petitioner.

Learned Additional Public Prosecutor fairly concedes that this is a covered matter in view of the above earlier order of this Court and thereby prayed to pass appropriate order in this Criminal Petition also.

Therefore, in view of the aforesaid common order of this Court and for the reasons stated therein, the Criminal Petition is allowed and the aforesaid F.I.R registered against the petitioner is hereby quashed.

Miscellaneous petitions, if any pending, in the Criminal Petition, shall stand closed.
