THE HONOURABLE SRI JUSTICE D.RAMESH

WRIT PETITION No.26686 of 2022

ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India, seeking to declare the action of the 2nd respondent in refusing to register the documents of the petitioners vide impugned orders bearing (1) Refusal No.15/2022 dated 28.06.2022 (2) Refusal No.16/2022 dated 07.07.2022 (3) Refusal No.11/2019 dated 27.06.2019 as illegal, null, void and against the principles of natural justice; consequently direct the 2nd respondent to receive, register and release the respective Sale Deeds of petitioners, executed by their vendors, forthwith.

  1. Heard learned counsel for the petitioners and learned Government Pleader for Revenue appearing for the respondents.

  2. Learned counsel for the petitioners submitted that the petitioners have purchased small extents of housing Plots from their vendors through various sale deeds. The 2nd respondent by similar orders, refused to register the said sale deeds of the petitioners on the ground that the property is covered by the Injunction Order of this High Court in C.R.P.M.P No.1546 of 2012 in C.R.P.No.1147 of 2012. Therefore, the petitioners herein filed the present Writ Petition jointly

and the case is covered by various judgments of this High Court and the composite High Court for the state of Telangana including W.P.No.19746 of 2020 dated 22.10.2020.

  1. Though the learned counsel for the petitioners has taken this Court to the injunction orders passed in C.R.P.M.P No.1546 of 2012 in C.R.P.No.1147 of 2012, the vendors of the petitioners were not a party to the said proceedings.

  2. Since the issue involved in this Writ Petition is covered by the order dated 10.02.2020 passed in W.P.No.2789 of 2020, this Writ Petition is allowed setting aside the impugned orders bearing (1) Refusal No.15/2022 dated 28.06.2022 (2) Refusal No.16/2022 dated 07.07.2022 (3) Refusal No.11/2019 dated 27.06.2019 of the 2nd respondent and directed the 2nd respondent to receive, process and register the documents in respect of the land in question within a period of four (04) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

As a sequel, miscellaneous applications pending, if any, shall also stand closed.
