HONOURABLE SMT. JUSTICE V.SUJATHA

WRIT PETITION No.22183 of 2023

ORDER:

The present Writ Petition came to be filed under Article 226

of the Constitution of India seeking the following relief:-

"…to issue a Writ, Order or direction more in the nature of Mandamus declaring that the petitioner is entitled for re-allotment/transfer to Bapatla district on spouse grounds from Palnadu district in terms of the policy of the Government to accommodate wife and husband at the same place or nearly place, considering the pathetic situation in which he is situated including the health condition of his wife Smt.A.Hema Latha, School Assistant, MPUPS Pedapuluguvari Palem, Bapatla District with all consequential benefits …

  1. The case of the petitioner, in brief, is that the petitioner was appointed as Police Constable in the year 1998 in Guntur District, subsequently promoted as Head Constable and presently working at Narasaraopet I Town Police Station. While so, wife of the petitioner i.e. one A.Hemalatha is working as School Assistant in MPUP Pedapuluguvari Palem of Karlapalem Mandal, Bapatla District and she is suffering from some health issues. Therefore, the petitioner submitted a representation to the 4th respondent requesting to consider the case of the petitioner for transfer to Bapatla District under spouse category. Despite the same, the respondents are not considering the request of the petitioner for his transfer from Palnadu District to Bapatla District. Hence, the present Writ Petition.

  2. Heard learned counsel for the petitioner as well as learned Government Pleader for Services I appearing for the respondents.

  3. Learned Government Pleader for Services-I, readily agreed to consider the representation made by the petitioner, dated 21.07.2023 and will pass appropriate orders in accordance with law.

  4. Having regard to the facts and circumstances of the case and submissions made by the learned Government Pleader for Services-I, instead of going into the merits of the case, this Court feels it appropriate to dispose of the Writ Petition directing the respondents to consider the representation made by the petitioner dated 21.07.2023 and pass appropriate orders, if not yet passed in accordance with law, within a period of two (2) weeks from the date of receipt of the copy of this order.

  5. Accordingly, with the above direction, this Writ Petition is disposed of. There shall be no order as to costs.

As a sequel, miscellaneous applications, pending, if any, shall also stand closed.
