THE HON'BLE SRI JUSTICE RAVI CHEEMALAPATI

WRIT PETITION NO.21676 OF 2023

ORDER:

This Writ Petition has been filed by the petitioner invoking the jurisdiction of this Court under Article 226 of the Constitution of India for the following relief:

"…..to issue an order or direction or Writ more particularly one in the nature of Writ of Mandamus by declaring the action of respondents in not processing and uploading the bill in respect of Agreement No.MD/LS/TW-VI/183/2018-19 dated 07.03.2019 for Rs.44,42,743,74/- in CFMS for payment as arbitrary illegal and in violation of Article 19(1)(g) of the Constitution of India and consequently direct the Respondents to process the bill by uploading in CFMS for Rs.44,42,743,74/- in respect of Agreement No.MD/LS/TW-VI/183/2018-19 dated 07.03.2019 and to pay the same forthwith and to pass such other order or orders as this Hon'ble Court deems fit and proper in the circumstances of the case…"

  1. Heard Sri Prakash Reddy, learned Counsel for the petitioner and Sri K.C. Venkat Reddy, learned Standing Counsel and learned Assistant Government Pleader for Home.

  2. The Sri K.C. Venkat Reddy, learned Standing Counsel on written instructions dated 22.08.2023 submitted that, as against the claim made by the petitioner to a tune of Rs.44,42,743.74/- the authorities are ready to pay to a tune of Rs.42,98,206/- which is net amount and are ready pay and however sought three (03) moths time for such payment.

  3. To the said submission, learned counsel for the petitioner reported no objection.

  4. Taking their submissions into consideration, as the authorities are willing to pay the amount to the petitioner, there is no purpose in keeping the writ petition pending, as such, this court is inclined to dispose of the writ petition with the following direction:

"The respondent-authorities are directed to release the legally entitled amount to the petitioner at the earliest not later than three (03) months".

  1. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous Applications, pending if any, shall stand closed.
