WHEREAS the Petitioner above named through his Advocate Sri T Vishnu Teja presented this Petition under Article 227 of the Constitution of India, the High Court may be pleased to allow the Civil Revision Petition by grant of interim injunction against the 1<sup>st</sup> Respondent herein from alienating the Suit schedule property and restraining the 2<sup>nd</sup> Respondent from taking further proceedings in respect of suit schedule property till the Interlocutory Application vide I.A.No 76/2021 in O.S.No 11/2021 filed under Order 39 Rule 1 & 2 on the file of the Principal Senior Civil Judge, Avanigadda was decided on merits.

AND WHEREAS the High Court upon perusing the petition and memorandum of grounds filed herein and upon hearing the arguments of Sri T Vishnu Teja, Advocate for the Petitioner, directed issue of notice to the Respondents herein to show cause as to why this CIVIL REVISION PETITION should not be admitted. You viz:

    1. Machiraju Madhu Kiran, S/o Padmanabha Rao, R/o Nidumolu Village, Movva Mandal, Krishna District.
    1. The Tahsildar, Movva Mandal, Krishna District.

are be and hereby directed to show cause either appearing in person or through an Advocate, as to why in the circumstances set out in the petition and the memorandum of grounds filed therewith (copy enclosed) this CIVIL REVISION PETITION should not be admitted, on or before 24.11.2021, on which date the case stands posted for hearing.

Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the 1<sup>st</sup> Respondent not to alienate the Suit schedule property and restraining the 2<sup>nd</sup> Respondent from taking further proceedings in respect of suit schedule property till the 1.A.No: 76/2021 in O.S.No: 11/2021 on the file of the Hon'ble Principal Senior Civil Judge, Avanigadda is decided on merits, pending disposal of CRP No.1150 of 2021, on the file of the High Court.

The Court made the following;

ORDER:

"Notice before admission.

Learned counsel for the petitioner is permitted to take out personal notice on the respondents 1 and 2, through RPAD and file proof of service.

Meanwhile, the 2<sup>nd</sup> respondent is directed not to proceed with the auction proceedings.

Post after four (04) weeks."
