Writ Petition No.26950 of 2021

ORDER:

This Writ Petition is filed under Article 226 of Constitution of India for the following relief/s:

"…to declare the inaction of the 3rd respondent in not disposing the petitioner's F-Line application vide application No.TANMU012107578793, dated 29.09.2021 and online application TAADLC011905682027, dated 28.01.2019 to mutate the petitioner name and issue E-pass book in favour of the petitioner in sy.no.12/3 in Sy.No.12/8 in sy.no.12/6 in sy.no.12/1 in sy.no.5/2 for extent of Ac.0.37 cents Ac.0.30 cents Ac.0.10 cent Ac.0.09 cents Ac.2.40 cents at pallipandredu village, Gurla Mandal, Vizianagaram District is highly illegal, arbitrary, violation of Articles 14, 21 and 300A of the Constitution of India and also violation of the ROR Act and also violation of the principles of natural justice consequently direct the 3rd respondent to dispose of the petitioner FLine application and online application to mutate the petitioner name and issue the Epass book in favour of the petitioner in the above subject land and to pass such other order or orders…"

Heard Sri T.Tejeswara Rao, learned counsel for petitioner and P.Subhash, learned Government Pleader for Revenue appearing for the respondents.

With a grievance that the Tahsildar, Gurla Mandal, Srikakulam District, the 3rd respondent herein is not considering his F-Line application bearing No.NMU012107578793, dated 29.09.2021 and online Application bearing No.TAADLC011905682027, dated 28.01.2019 made through Mee-seva for mutation of his name and for issuance of E-pass, the petitioner herein, has come up before this court with the present Writ Petition.

It is brought to the notice of this Court by the learned counsel for the petitioner that in similar circumstances, this Court disposed of the Writ Petition No.1339 of 2021 by way of an order dated 20.01.2021.

In view of the above reasons, without expressing any opinion on the merits of the matter, the Writ Petition is disposed of directing the Tahsildar, Gurla Mandal, Srikakulam District, the 3rd respondent herein, to take an appropriate action on the F-Line application bearing No.NMU012107578793, dated 29.09.2021 and online Application bearing No.TAADLC011905682027, dated 28.01.2019, submitted by the petitioner through Mee-seva, within a period of six (6) weeks from the date of receipt of a copy of this order. No costs.

Miscellaneous petitions pending if any, shall stand closed.

Registry is directed to enclose a copy of the order dated 20.01.2021 in W.P.No.1339 of 2021 to this order.
