WHEREAS the Petitioners have presented under Sections 10 to 12 of the Contempt of courts Act 1971, above case through his Counsel Smt Marella Radha, praying that this Hon'ble High Court may be pleased to punish the respondents herein for their violating of the orders in W.P.No.17269 of 2022, dated 28.06.2022;
And Whereas the court upon perusing the petition and affidavit filed in support thereof and the orders of High Court dated.07.09.2022 & 05.09.2023 made herein and upon hearing the arguments of Smt Marella Radha Advocate for the Petitioner and of Sri Manohar Reddy Mallasani Advocate for the Respondent, made the following
ORDER:
"Smt. Marella Radha, learned counsel for the petitioners would submit that the officials of the Municipal Corporation had come to the site on 11.09.2023 at 10:30 AM. However, they did not identify the land of the petitioners and after a brief discussion had left the place.
Sri M. Manohar Reddy, learned counsel appearing for the respondents would submit that the location of the land of the petitioners was shown to the petitioners on that day.
As this is a disputed question of the fact, it would be appropriate for this Court to appoint an Advocate Commissioner in whose presence the respondents shall identify the land of the petitioners.
Accordingly, Smt. Y. Mahalakshmi, learned counsel is appointed as Advocate Commissioner on a fee of Rs.15,000/-, to be present at Sampath Nagar park at 11.00 AM on 08.10.2023. Both the petitioners and the respondents shall be present and the respondents shall identify the land of the petitioners and show the boundaries of the land to the petitioners, in the presence of the learned Advocate Commissioner.
Post on 13.10.2023."
