WHEREAS the Petitioner has presented under Sections 10 to 12 of the Contempt of courts Act 1971, above case through his Counsel SMT MARELLA RADHA, praying that this Hon'ble High Court may be pleased to punish the respondents herein for their violating of the orders in W.P.No.17269 of 2022, dated 28.06.2022,

WHEREAS the said case coming on for hearing on this day and whereas the High Court upon perusing the affidavit field herein and the order of High Court dated.07.09.2022, made herein and upon hearing the arguments of SMT MARELLA RADHA Advocate for the Petitioners and of SRI MANOHAR REDDY MALLASANI Advocate for the Respondent, made the following

ORDER:

The petitioner had approached this Court with the complaint that the land of the petitioner situated in Sy.No.673/3 was being encroached by the respondent-authorities, who were seeking to construct a park in the land of the petitioner.

This Court by an order dated 28.06.2022 had directed the respondents not to undertake any constructions in the land being claimed by the petitioner.

In the present Contempt Case, the petitioner contends that his land in Sy.No.673/3 was encroached upon by the respondent-authorities, who constructed a park in the land of the petitioner despite knowledge of the orders of this Court. $\angle$

In the counter affidavit filed by the respondents. It is stated that a survey was conducted by the town surveyor and the town surveyor has certified that the park was built in the land of the Corporation in Sy.No.673/2. A report of the surveyor has also been placed before this Court. This report shows that the land of the petitioner available in Sy No.673/2 has also been identified.

In the circumstances, it would be appropriate to direct the respondents to identify and show the land of the petitioners to the petitioner. It would be open for the petitioner or his representative to be present on 11.09.2023 at 10.30 a.m. On that day, the respondents or their representatives along with the surveyor shall identify the land of the petitioner in Sy.No.673/2.
