THE HON'BLE SRI JUSTICE D.V.S.S.SOMAYAJULU

WRIT PETITION NOs.17560, 17402, 17405, 17461, 17508, 17607, 17612, 17616, 17624, 17702, 17996, 17997, 18176, 18211, 19337, 19344, 19672, 20452, 20570, 20699, 20996, 21162, 21329, 21332, 21529, 23328, 23435, 23483, 23502, 23507 and 23521 of 2021

ORDER:

Since the issue involved in all the writ petitions is one and the same and the writ petitions are being disposed of by this common order.

  1. Heard learned counsel for the petitioners and the learned Government Pleader for Services-III, who argues the matter basing on the instructions, dated 31.10.2021.

  2. Learned counsel for the petitioners points out to the orders passed by this Court on 22.09.2021 and 06.10.2021 and he categorically asserts that the petitioners before this Court are claiming relief based upon them.

  3. Learned counsel for the petitioners argues that the cases of the petitioners are squarely covered by the orders of the Division Bench in W.P.Nos.31491, 31496, 31507 and 33315 of 2013. He submits that the Coordinate Bench of this Court has already passed order in W.P.No.16269 of 2013. Learned counsel for the petitioners also points out that the legal and factual issues in all these cases are identical except the amounts referred in each case. Therefore, he prays for disposal of the writ petitions.

  4. The instructions given to the learned Government Pleader for Services-III and learned Government Pleader for School Education clearly mentioned that if these petitioners are on the same footing as the petitioners in the writ petitions before the Division Bench etc. their cases would be considered as per their eligibility.

  5. Since nothing further survives in the writ petitions, as it is clearly asserted that the State is willing to consider the cases of the petitioners and they are similarly placed, these Writ Petitions are allowed directing the respondents to effect the payments of the withheld gratuity amounts in each case along with interest as prayed for, within three (3) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

Miscellaneous petitions pending, if any, shall stand closed.
