Appeal filed under Section 100 of C.P.C. against the judgment and decree dated 28-04-2000 passed in A.S. No. 37 of 1996 on the file of the Principal Senior Civil Judge, Gudur, SPSR Nellore District preferred against the Judgment and Decree dated 19-09-1996 passed in O.S. No. 30 of 1992 on the file of the District Munsif Court, Kota, SPSR Nellore District.

The Appeal coming on for hearing and upon perusing the Memorandum of Appeal, the Judgments and Decrees of the Trial Court and the Appellate Court evidence on record and upon hearing the arguments of Sri P. Ganga Rami Reddy. Advocate for the Appellants and Sri M.P. Chandra Mouli, Advocate for the respondent, this Court Doth Order and Decree as follows:-

1. That the Second Appeal be and hereby is allowed.

• 2. That the decree and judgment dated 28/04/2000 in A.S. No. 37 of 1996 on the file of Principal Senior Civil Judge, Gudur be and hereby is set aside.
• 3. That the Judgment and decree dated 19/09/1996 in O.S. No.30 of 1992 on the file of the District Munsif, Kota be and hereby is restored.
• 4. That the appellants right in respect of 'B' Schedule property be and hereby is declared and consequential relief of permanent injunction is also granted in addition to the relief of recovery of possession granted by the trial Court and the said reliefs granted inconformity with the judgment of the trial Court.

5. That the parties be and hereby are directed to bear their own costs throughout.
