Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus declare the provisional order cum notice vide Notice No. 87/1012/TPT/UC/2022, dated 06-07-2022 issued by the Respondent No.2 and there by not allowing the petitioner to construct the building as per the sanction plan dated 16-06-2021, as illegal, arbitrary and violation of Art.14, 21 and 300-A of Constitutional of India and consequently set-aside the Notice No. 87/1012/TPT/UC/2022, dated 06-07-2022 issued by the Respondent No.2 and further direct the respondents Nos. 2 and 3 not to obstruct the petitioner in construction of building constructing as per sanction plan dated 16-060-2021.

IA NO: 1 OF 2022

Petition under Section 151 CPC is filed, praying that in the circumstances stated in the affidavit filed in support of the writ petition, the High Court may be pleased to Stay all further proceedings in Notice No. 87/1012/TPT/UC/2022, dated 06-07-2022 by directing the Respondents No. 2 and 3 not to interfere with the construction of the building, pending disposal of WP No.22419 of 2022, on the file of the High Court.

The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and the order of the High Court dated 25.07.2022 made herein and upon hearing the arguments of Sri Ramineni Sudheer Advocate for the Petitioner(s), GP for Municipal Administration and Urban Development for the Respondent No. 1 and Sri. K. Suresh Kumar Reddy, Standing Counsel for Respondent No. 2 &3 and the Court made the following.

ORDER

"Sri P. Anand Surya, learned counsel, representing Sri K. Suresh Kumar Reddy, learned standing counsel for respondents No.2 and 3, submits that he has received instructions and seeks 4 weeks time to file counter affidavit.

If counter affidavit is filed, reply affidavit, if any, may be filed by the learned counsel for the petitioner, within further period of two weeks.

List on 11.10.2022.

Interim order granted earlier is extended till the next date of listing."
