WRIT PETITION No. 23846 of 2021

ORDER:

This writ petition is filed by the petitioner under Article 226

of the Constitution of India for the following reliefs:

"...to issue a writ more in the nature of writ of mandamus or any other writ order or direction to declare the action of the 2nd respondent in continuing the disciplinary proceedings initiated vide charge memo bearing No.11259/CPR/E2.vig/2005 dated 20.07.2006 for a long period is illegal, arbitrary, unconstitutional and void being contrary to the Government instructions issued in G.O.Ms.No.679, dated 01.11.2008 and as well as contrary to the Law laid down by the Hon'ble Supreme Court of India and set aside the same with all consequential benefits and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

2. When the matter is taken up for hearing, Sri R. Rajasekhar Rao, learned counsel for the petitioner, submits that the issue involved in this writ petition is squarely covered by the order dated 05.07.2022 passed by this Court in Writ Petition No.21768 of 2021 and requested to pass a similar order in this writ petition also. The same is not disputed by learned Government Pleader for Services-IV appearing for the respondents.

3. In view of the same, for the reasons alike in the aforesaid order, this Writ Petition is also allowed in terms of the order dated 05.07.2022 passed by this Court in Writ Petition No.21768 of 2021. There shall be no order as to costs.

4. Registry is directed to attach a copy of the order dated 05.07.2022 passed by this Court in Writ Petition No.21768 of 2021 to this order.

As a sequel thereto, interlocutory applications, if any pending, shall stand closed.
