WHEREAS the Appellant above named through his Advocate Sri Y.SUBBA RAO presented this Second Appeal under Section 100 CPC against the order dated pleased to Set-a-side the Judgment and Decree dated 02-05-2024 passed by Additional Civil Judge (Senior Division), (FTC) Bapatla, in A.S.No.40 of 2019, confirming the Judgment and Decree dated 23-04-2019
passed in O.S.No.26 of 2012 by Principal Junior Civil Judge (Junior Division), Bapatla, and consequently be pleased to decree the Suit O.S.No.26 of 2012, filed by the Appellant herein, restraining the Respondents, his agents and any other person acting under them in interfering with the peaceful possession of Appellant over the Suit Schedule Property;
AND WHEREAS the High Court upon perusing the petition and memorandum of grounds filed herein and upon hearing the arguments of Sri Y.Subba Rao, Advocate for the Petitioner, directed issue of notice to the Respondents herein to show cause as to why this SECOND APPEAL should not be admitted.
