ORDER:

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue, who seeks further time, to secure necessary instructions from the concerned respondents.

  1. The writ petition is filed seeking to declare the highhanded action of the 4th respondents in trying to dispossess the petitioner from the lands of an extent of Acs.4.08 cents in Survey No.1927 and Ac.0.70 cents in Survey No.1657/1 of Araveedu Village, without issuing any notice, without following due process of law, as illegal, arbitrary, violation of

principles of natural justice, and for a consequential direction.

  1. Learned counsel for the petitioner, inter alia submits that the petitioner was assigned the subject matter lands under landless poor category vide DKT No.3/1406, dated 20.11.1996 and Pattadar Pass Book and Title Deeds were issued in favour of the petitioner and she is in peaceful possession and enjoyment of the same. She submits that the petitioner obtained crop loan by depositing the title deed. She submits that on 17.7.2023 the 4th respondent along with his staff came to the subject matter property for survey and on enquiry, the petitioner came to know that they were searching for the land for the purpose of allotment to some beneficiaries. Learned counsel submits that the respondents are trying to interfere with the subject matter land, for assigning the same to third parties, without having any manner of right and without following due process of law. She submits that unless the respondents are directed not to interfere with the subject matter property, the petitioner's valuable rights over the subject matter lands would be infringed and the petitioner suffers irreparable prejudice and hardship.

This Court has considered the submissions made and perused the material on record, including the latest adangal dated 03.7.20223, wherein pattadar's column in respect of the subject matter lands reflects the name of the petitioner. In view of the same, the writ petition is disposed of, with a direction to the respondents not to interfere with the subject matter property or take any coercive action in respect of the same, without following due process of law.

  3. The writ petition is disposed of, accordingly. No order as to costs. Miscellaneous petitions pending, if any, shall stand closed.
