WRIT PETITION No.16603 of 2019

ORDER:

This writ petition is filed under Article 226 of the Constitution of India, questioning action of the 4th and 5th respondents in not allotting the essential commodities to this petitioner for distribution to the cardholders, declaring such action is illegal, arbitrary and violative of Articles 14, 19(1) (g) of the Constitution of India.

2. As seen from the material on record, the petitioner allegedly violated the Andhra Pradesh State Targeted Public Distribution System (Control) Order, 2018 (for short 'the Control Order') and proceedings were initiated against this petitioner. During the pendency of the enquiry, the petitioner was denied supply of the essential commodities for distribution of the same to the cardholders. But, at the time of admission, the learned Assistant Government Pleader for Civil Supplies brought to the notice of this Court that the authorization of this petitioner was suspended and that therefore, the respondents are not under obligation to supply the essential commodities to this petitioner to run the fair shop price and a copy of the order is supplied to the learned counsel for the petitioner on record, across the bar, and receipt of the said order was acknowledged by the learned counsel for the petitioner, Sri P. Narahari Babu and he requested to permit the petitioner to file appropriate petition challenging the suspension order.

3. In view of the submissions made by the learned counsel for the petitioner, the writ petition is dismissed, granting liberty to the petitioner to file appropriate petition challenging the suspension order.

As a sequel, pending miscellaneous petitions, if any, shall stand dismissed.
