WHEREAS the Appellants above named through their Advocate Sri Harinath Reddy Soma, presented this Second Appeal under Section 100 CPC, begs to present the above Second appeal against the Judgment dt.17-04-2023 in A.S No.05 of 2018 on the file of VI Additional District Judge, Kadapa Confirming the Decree and Judgment dt.09-11-2017 in O.S No.237 of 2011 on the file of In the Court of Principal Junior Civil Judge, Kadapa.

AND WHEREAS the High Court upon perusing the petition and memorandum of grounds filed herein and upon hearing the arguments of Sri A.Sreeram, learned counsel representing Sri Harinath Reddy Soma, Advocate for the Appellants, directed issue of notice to the Respondents herein to show cause as to why this SECOND APPEAL should not be admitted.

Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to Suspend the Order and Decree dt.17-04-2023 in A.S No.05 of 2018 on the file of VI Additional District Judge, Kadapa, pending disposal of SA No. 183 of 2024, on the file of the High Court.

THE COURT MADE THE FOLLOWING ORDER:

"Issue notice before admission.

The learned counsel for the appellants is permitted to take out personal service of notice to the respondents no.1 & 2, by RPAD, and file proof thereof.

Post on 07.08.2024.

A.Sreeram, learned counsel representing the counsel for the appellants submitted that there is one more second appeal vide SA No.94 of 2024 which is connected to the batch of matters posted today and requested SA No.94 of 2024 also to be posted along with them.

The learned counsel for the respondents no.1 and 2 in S.A.No.183 of 2024 and respondents no.1 to 4 in S.A.No.103 of 2024 represented that he would file vakalat for some of the respondents in S.A.No.92 of 2024 and S.A.No.101 of 2024 and requested time.

Registry is directed to post these matters along with S.A.No.94 of 2024 on 07.08.2024."
