WRIT PETITION No.20476 of 2021

ORDER:

This writ petition, under Article 226 of the Constitution of India is filed to declare the action of the respondents, more particularly respondent No.2, in trying to evict/remove the petitioner from possession and occupation of property admeasuring 333 Sq.yards in Door No.1-2, Jodugillapalem, Revenue Ward No.6, Visakhapatnam, pending consideration of application for regularization, without following due process of law as arbitrary and illegal and consequently to direct the respondent No.3 to consider his application for regularization and not to evict/remove him from his possession and occupation of the subject property.

Heard the learned counsel for the petitioner, learned Government Pleader for Municipal Administration and Urban Development appearing for the 1st respondent, Sri V.Surya Kiran Kumar, learned Standing Counsel appearing for respondent No.2 and learned Government Pleader for Revenue appearing for respondent Nos.3 to 6.

With the consent of both the learned counsel, this writ petition is disposed of at the admission stage.

At the hearing, both the learned counsel submit that this Court, by order dated 14.09.2021, disposed of W.P.No.19983 of 2021, wherein the facts are identical to this writ petition and hence, this writ petition is also disposed of by passing a similar order.

Recording the above submissions, this writ petition is disposed of directing the 4 th respondent-District Collector, to consider the application of the petitioner for regularization of the land as per G.O.Ms.No.388 dated 24.08.2017, within four weeks from the date of receipt of a copy of this order. Till such time, both the parties are directed to maintain status quo. No costs.

The miscellaneous petitions pending if any, shall also stand closed.
