WRIT PETITION No.20712 of 2021

ORDER:

Learned counsel for the petitioner, learned Government Pleader for Mines & Geology, representing on behalf of the respondents 1 and 2 and learned Government Pleader for Home, representing on behalf of the 3rd respondent, would agree that the issue in this writ petition is covered by the order passed in W.P.No.671 of 2020, dated 08.01.2020. It is also submitted by the learned Government Pleader that so far the subject vehicle has not been produced before the jurisdictional Magistrate.

2. In that view of the matter, this writ petition is disposed of in terms of order in W.P.No.671 of 2020, dated 08.01.2020 and the respondent authorities are directed to impose penalty in terms of Clause 16 of G.O.Ms.No.71, dated 04.09.2019 and on payment of such penalty by the petitioner, the respondents shall release the seized lorry bearing No.AP 05TN 1197, to the petitioner upon his producing proof of ownership of the said vehicle to the satisfaction of 3 rd respondent. No costs.

As a sequel, interlocutory applications pending, if any, shall stand closed.
