ORDER:

Heard Mrs.Santhi Sree Vallabhaneni, learned counsel appearing on behalf of the learned counsel for the petitioners and the learned Assistant Public Prosecutor appearing for the 1 st respondent. Notice to the 2 nd respondent is deemed not necessary as the matter is disposed of, without going into merits of the case.

  1. The present Criminal Petition is filed seeking to quash the proceedings in C.C.No.491 of 2022 on the file of the VII Additional Junior Civil Judge, Rajamahendravaram, East Godavari District, registered under Sections 417, 494 R/w Section 34 of IPC against the petitioners/Accused Nos.3 and 4.

  2. The petitioners are Accused No.3 and 4 in the said Calendar Case. Though the learned counsel for the petitioners raised several grounds seeking to quash the proceedings in C.C.No.491 of 2022 on the file of the VII Additional Junior Civil Judge, Rajamahendravaram, East Godavari District, at the time of making submissions, confined arguments to the relief of dispensing with the presence of the petitioners/Accused Nos.3 and 4 before the Trial Court.

  3. Considering the submissions made and perusing the material on record, this Court is inclined to consider the prayer of the learned counsel for the petitioners for dispensing with the presence of the petitioners/Accused Nos.3 and 4 only before the Trial Court.

  4. Accordingly, the Criminal Petition is disposed of by dispensing with the appearance of the petitioners/Accused Nos.3 and 4 before the VII Additional Junior Civil Judge, Rajamahendravaram, East Godavari District, except on the dates, when it is necessary.

As a sequel, miscellaneous applications if any, pending shall stand closed.
