THE HON'BLE SRI JUSTICE CHEEKATI MANAVENDRANATH ROY WRIT PETITION No.19560 OF 2021

ORDER:-

The grievance of the writ petitioner is that respondents 2 and 3, who are the Station House Officers of Pindlimarri Police Station of YSR Kadapa District and Chillakallu Police Station of Krishna District respectively, have been insisting the petitioner to settle the civil disputes with the 4th respondent by threatening him to foist false criminal cases against him and thereby interfering in the civil disputes between the petitioner and respondents 4 and 5.

Therefore, he sought for declaration that the said action on the part of respondents 2 and 3 in interfering in the civil disputes is illegal, arbitrary and unconstitutional and consequently sought direction to respondents 2 and 3 not to interfere in the civil disputes between the petitioner and respondents 4 and 5.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home, on instructions, would submit that on a report lodged by the 5th respondent against the petitioner that a case in Crime No.840 of 2021 was registered by Chillakallu police for the offences punishable under Sections 420 and 409 IPC and on a report lodged by one J.Sambasiva Rao that another case in Crime No.128 of 2021 was registered by Pindlimarri police against the petitioner for the offence punishable under Section 506 IPC and both the cases are now under investigation. He would further submit, on instructions, that respondents 2 and 3, except registering the said crimes, never interfered in any civil disputes between the petitioner and respondents 4 and 5 and that they never threatened to foist false cases against the petitioner, if they fail to settle the disputes with respondents 4 and 5, as alleged in the Writ Petition.

Therefore, recording the aforesaid submission of learned Assistant Government Pleader for Home, on instructions, that respondents 2 and 3 are not interfering in any such civil disputes between the petitioner and respondents 4 and 5 and that they never insisted the petitioner to settle the said disputes with respondents 4 and 5, this Writ Petition is closed.

However, as regards the aforesaid two crimes that were registered against the petitioner, the law has to take its own course.

Miscellaneous Petitions, if any pending, in this Writ Petition, shall stand closed.
