ORDER:

The writ petition is filed to declare the action of respondents in not paying the compensation @ Rs.5,50,000/ per acre as per G.O.Ms.No.259 dated 21.06.2016, in spite of notice dated 31.08.2020, as illegal and arbitrary.

  1. On 11.11.2020, learned Single Judge of this Court directed the respondents to send response to the notice dated 31.08.2020, within a period of two weeks from the date of receipt of a copy of order, dated 11.11.2020.

  2. Today, when the matter is taken up, learned Assistant Government Pleader appearing for the respondents passed on the proceedings of Sub-Collector, Nandyal vide Rc.B.238/2018 dated 09.03.2021, whereby the authority replied to the notice got issued by the petitioner.

  3. As seen from the proceedings, reply was communicated to learned counsel for the petitioner.

  4. Sri A.Srinath, learned counsel for the petitioner would submit that due to Covid-19 pandemic, his office was closed and proceedings of the Sub-Collector were not served on him.

  5. A copy of the proceedings was handed over to learned counsel for the petitioner by learned Assistant Government Pleader appearing for the respondents in the Court. Learned counsel for the petitioner acknowledged the same.

  6. Learned counsel for the petitioner seeks permission to withdraw the present writ petition with a liberty to challenge the proceedings issued by the Sub-Collector vide Rc.B.238/2018 dated 09.03.2021.

  7. Permission is accorded.

  8. Accordingly, this Writ Petition is dismissed as withdrawn, giving liberty to the petitioner to challenge the proceedings before appropriate forum. No order as to costs.

As a sequel, all the pending miscellaneous petitions shall stand closed.
