SMT. JUSTICE T. RAJANI
WRIT PETITION No.14741 OF 2019
ORDER:
This writ petition is filed, under Article 226 of the Constitution of India, seeking to declare the action of the respondent in not accepting delivery of the goods manufactured by the petitioner pursuant to the purchase orders issued by the respondent, as illegal.
-
Heard the counsel for the petitioner. None appears for the respondent, in spite of service of notice.
-
The counsel for the petitioner submits that there were purchase orders issued to the petitioners for certain goods, but the goods manufactured by the petitioner were not taken by the respondent on the ground that there was Election Code. The grievance of the petitioner is that even after the elections, the goods are not being taken delivery by the respondent and they are lying with the petitioner.
-
Hence, in view of the above circumstances, this Court deems it fit to direct the respondent to take delivery of manufactured goods, pursuant to the purchase orders issued to the petitioner, within a period of four weeks from the date of receipt of a copy of this order.
-
The writ petition, with the above direction, is disposed of.
As a sequel, miscellaneous petitions pending consideration if any in the writ petition shall stand closed.
