It is stated that the counsel engaged by the | |||
applicants<br>had not appeared before the<br>writ Court | |||
and that his<br>name also did not figure in the | |||
judgment<br>and<br>order,<br>which<br>is<br>sought<br>to<br>be | |||
challenged<br>in the<br>present writ appeal. | |||
It is stated that the applicants<br>came to know | |||
about the judgment and order impugned when | |||
there was some murmering in the village that the | |||
writ petitioners<br>had succeeded before the learned | |||
Single Judge. It is stated that upon verification<br>of | |||
the status of the case, it was found that the writ | |||
petition had<br>since been disposed of by the writ | |||
Court.<br>It<br>is<br>further<br>stated<br>that<br>immediately | |||
thereafter, the applicants<br>had applied for a copy of | |||
the judgment and order impugned and filed the | |||
present writ appeal. | |||
Objections<br>have<br>been<br>filed<br>by<br>the | |||
non-applicants<br>in<br>which<br>it<br>is<br>stated<br>that<br>the |
applicants have all along had the knowledge of proceedings before the writ Court and had chosen not to contest the writ petition to drag on the litigation.
We have heard the learned counsel for the parties.
On a perusal of the judgment and order impugned, it can be seen that the name of the counsel engaged by the applicants has not been reflected. It appears that the applicants were under a bona fide impression that the case can be taken care of by the counsels so engaged by the applicants, who neither appeared before the writ Court nor informed the applicants about the disposal of the same.
Having gone through the application, we find that sufficient cause has been shown for condonation of delay.
Accordingly, the delay is condoned subject to costs of Rs.1,000/- (Rupees one thousand only) to be deposited by the applicants in the Advocates' Welfare Fund within two (2) weeks from today.
