THE HON'BLE SRI JUSTICE K.SURESH REDDY

CRIMINAL PETITION No. 4381 OF 2023

ORDER:

The present criminal petition, under Section 438 Cr.P.C., is filed by the petitioner-accused seeking his release on bail in the event of arrest in crime No. 266 of 2023 of Suryaraopet Police Station, NTR Commissionerate, registered for the offences punishable under Sections 409, 406, 420 and 506 IPC.

  1. Heard Sri Lakshmikanth Reddy Desai, learned counsel appearing for the petitioner-accused, and learned Special Assistant Public Prosecutor appearing for the respondent-State.

  2. Case of the prosecution is that in the year 2010, de facto complainant along with his wife intended to start a business in imports and exports. At that juncture, the petitioner approached de facto complainant and stated that he was having experience in the said business and if de facto complainant entrusts work to him, he would see that profits would be obtained in the business. Believing his version and being induced by the conduct of the petitioner, de facto complainant paid money through phonepe, online and cash to the petitioner. On the request made by the petitioner, de facto complainant also provided a car which stands in the name of his wife. From then onwards, in spite of repeated requests made by de facto complainant, there was no answer from the petitioner. Finally, the petitioner said to have refused and evaded to give answer. Thereafter, de facto complainant gave the present report.

Learned counsel for the petitioner contends that the report is quite silent with regard to the dates on which de facto complainant allegedly paid amounts to the petitioner and the report is vague and that even according to the report given by de facto complainant, the so called incident took place in the year 2011 and he came up with the present report after 12 years.

  4. In that view of the matter, this Court is inclined to grant anticipatory to the petitioner.

  5. In the event of his arrest, the petitioner-accused is ordered to be enlarged on bail on his executing a personal bond for Rs.25,000/- with two sureties for the like sum each to the satisfaction of Station House Officer, Suryaraopet Police Station, NTR Commissionerate. The petitioner-accused is directed to

cooperate with the investigation and not to tamper with the prosecution witnesses.

  1. Accordingly, the criminal petition is allowed.
