HON'BLE SRI JUSTICE K.SURESH REDDY

W.P.No. 17985 of 2022

ORDER:-

The present writ petition is filed seeking the following relief:-

"to issue a writ, order or direction more particularly one in the nature of writ of Mandamus declaring the inaction of the Respondents in not renewing the leasehold fishing rights of the petitioner for the Lingappa Cheruvu and Imambeg Cheruvu irrigation tanks of Settivaripalli Village Gramapanchayat, Settivaripalli Village, Guramkonda Mandal, Annamaya District, A.P in terms of the G.O.RT.No.48, Dated 20-02-2016 Fisheries Department for the Fasili 1431 to 1432 from 01-07-2022 to 30-06- 2023 as illegal, arbitrary, and vilolation of law, Consequently direct the Respondents to consider the Renewal of the my Fishing leasehold rights for the Lingappa Cheruvu and Imambeg Cheruvu irrigation tanks of Settivaripalli Village, Gramapanchayat, Settivaripalli Villlage, Guramkonda Mandal, Annamaya District, A.P in terms of the G.O.RT.No.48, Dated 20-02-2016 Fisheries Department for the Fasili 1431 to 1432 from 01-07-2022 to 30-06- 2023."

Along with the writ petition, the petitioners have also filed I.A.No.1 of 2022 seeking a direction to the respondents to consider their representations, dated 09-06-2022 and

13-06-2022 by extending the time till the month of September,2022 in accordance with law for the subject irrigation tanks.

This court by way of interim order, dated 29-06-2022 granted the order of status quo in all respects.

As can be seen from the record, since the lease period itself was over and the request of the petitioner for extension of the lease period till 22-09-2022 was also over, petitioners are not permitted to do the fishing activities in the subject tanks.

In view of the above facts and circumstances of the case, without going into the merits or demerits of the case, the present writ petition can be closed since the lease period as well as the extension period was also completed by efflux of time.

Accordingly, the writ petition is closed. No order as to costs.

Miscellaneous Petitions pending, if any, shall stand closed in consequence.
