THE HON'BLE SRI JUSTICE D.V.S.S.SOMAYAJULU & THE HON'BLE SRI JUSTICE V. SRINIVAS

Writ Petition Nos.21604, 21631, 21639 & 21683 of 2012 COMMON ORDER:

Heard learned counsel for the petitioners and learned counsel for respondents.

The impugned order passed by the Administrative Tribunal directed the respondents to have a fresh look into the entire issue raised by the petitioners. This was challenged in this writ petition.

Similarly, placed petitioners who were working in the State of Telangana have approached the High Court of Telangana which has passed orders in W.P.No.21638 of 2012 holding as follows:

"5. Having considered the rival contentions made by the parties, this Court is of the considered view that the Tribunal has merely directed the petitioners to re-examine the case of the respondents. Therefore, this Court is not able to understand how the petitioners are aggrieved in the present case. Therefore, this Court is not inclined to interfere with the orders passed by the Tribunal and the writ petition is liable to be dismissed."

This Judgment is cited by the learned counsel for the petitioners stating that very same order has to be passed in these cases also.

After considering the submissions and noting the contentions, this Court notices that the respondents were merely directed to re-examine the case. There is no positive direction given other than this. Therefore, a similar order is passed in these matters also, in line with the orders in W.P.No.21638 of 2012. No ground is made out to interfere.

With these observations, writ petitions are dismissed. There shall be no order as to costs.

As a sequel, Miscellaneous Applications, if any, pending shall also stand dismissed.
