HON'BLE SRI JUSTICE R. RAGHUNANDAN RAO WRIT PETITION No.20016 of 2020

ORDER:

The petitioner, who is working as School Assistant, sought promotion to Head Master Grade-II in the Government High School for Blind, YSR Kadapa District.

  1. As he was aggrieved by the non-promotion, he approached this Court by way of W.P.No.16400 of 2019, which was disposed of on 22.10.2019 with a direction to the respondent No.3 to consider the representation of the petitioner dated 09.09.2019 regarding his eligibility and entitlement for being promoted.

  2. The Regional Joint Director of School Education, who was respondent No.3 in that writ petition and is presently arrayed as respondent No.4, had disposed of the said representation by an order dated 22.07.2020, rejecting the claim of the petitioner on the ground that one Sri Nagaiah, was working as Head Master of the said school and there was no clear existing vacancy. The respondent No.4 also held that as and when a vacancy arises in the said school due to retirement or transfer, the plea of the petitioner would be considered as per Rules based on his seniority and eligibility.

  3. Sri J.Sravan Kumar, learned counsel for the petitioner submits that Sri Nagaiah is retiring on 24.12.2020 and in view of the said retirement, the petitioner has made a representation dated 15.10.2020 to the respondent No.2 for being promoted.

  4. Aggrieved by the inaction of the respondent No.2 in disposing of the said representation dated 15.10.2020, the petitioner has now approached this Court.

  5. Heard Sri J.Sravan Kumar, learned counsel for the petitioner and Sri K.Bheema Rao, learned Government Pleader for Services-III.

  6. In view of the observations of the respondent No.4 in his order dated 22.07.2020, it would be appropriate to dispose of this writ petition with a direction to the respondent No.2 to consider and pass orders on the representation of the petitioner dated 15.10.2020 within a period of three (3) weeks from the date of receipt of a copy of this order.

  7. Accordingly, the writ petition is disposed of. There shall be no order as to costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
