The Court made the following order:
Heard learned counsel for petitioners.
- The grievance of the petitioners, who are defendants in O.S. No.229 of 2017, is that the 3^'^ petitioner herein is an aged lady and senior citizen and that the suit is of the year 2017 and the trial court unfortunately has not been conducting the trial in a reasonably quick manner and thereby, the petitioners are facing much hardship. The request of the petitioners now is that CRP is
filed under Article 227 of the Constitution of India seeking supervisory jurisdiction of this Court, is to direct the trial court to expedite the trial in O.S. No.229 of 2017.
- When enquired, learned counsel for petitioners would submit that expedite petition has not been filed so far in the trial court.
In that view, this Court is of the considered view that liberty 4. can be given to the petitioners to move an expedite petition before the trial court.
- Accordingly, this CRP is disposed of giving liberty to the petitioners to submit an expedite petition before the trial court to expedite the trail in O.S. No.229 of 2017, in which case, the trial court shall consider the said application and after hearing both sides, pass an appropriate order within one week from the date of filing of such application and proceed with the trial of the matter depending upon the result of the said petition. No costs.
As a sequel, interlocutory applications pending, if any, in this case shall stand closed.
