THE HONOURABLE SRI JUSTICE BATTU DEVANAND
W.P. No.17282 of 2021
ORDER:-
This Writ Petition has been filed to issue a Writ of Mandamus declaring the action of respondent Nos. 2,4 and 6 in not paying the financial assistance i.e., 2nd installment (due payable for the year 2020) under Y.S.R. Chayutha Scheme to the petitioners in terms of G.O.Ms.No.636, dated 12.06.2020 and Memo No.1186432/RD.1/A1/2020-2, dated 27.07.2020 on par with the other similar and eligible beneficiaries as illegal, arbitrary and violative of Articles 14,19 and 21 of the Constitution of India and for a consequential direction to the respondents to extend the benefit/financial assistance to the petitioners.

Krishna Rao, learned counsel for the petitioners and the learned Government Pleader for Panchayat Raj for Respondent Nos.1,2 and 4 and Sri Ravi Teja Padiri for Respondent Nos. 3 and 5 and Sri I. Koti Reddy, learned Standing Counsel for Respondent No.6 and perused the material available on record and with their consent, the Writ Petition is disposed of at the stage of admission.

Learned counsel for the petitioners submits that all the petitioners are residents of Penubarthi Village of Ponduru Mandal. All the petitioners are women belonging to SC, ST, BC and Minority Communities and economically weaker sections. They are all in the age group of 45 to 60 years.

Respondent No.1 issued G.O.Ms.No.636, dt. 12.06.2020 introducing a scheme named as "YSR Cheyutha". Under "Navaratnalu" scheme for granting financial assistance of Rs.18,750/- in four phases i.e., total of Rs.75,000/- to the women, who are belonging to BC, SC and ST and Minority Communities, the petitioners" submitted applications for financial assistance under the said scheme.

The grievance of the petitioners is that considering their eligibility criteria, they were granted financial assistance of Rs.18,750/- for the year 2020, but for the present year i.e., 2021, the said benefit was not extended to the petitioners. Aggrieved by the same, the present Writ Petition is filed.

Learned counsel appearing for the respondents submits that if the petitioners fulfilled the eligibility criteria, not including their names in the beneficiaries list or not extending the benefit for the subsequent year does not

arise. If any complaint made against the eligibility of the petitioners, after verification of the eligibility, the benefit will be extended in favour of the petitioners if they fulfilled their eligibility criteria.

Having heard the submissions of the learned counsel and upon perusal of the material available on record, in the opinion of this Court, the action of the respondents in not extending the benefit under the scheme for the subsequent year as and when they extended the said benefit after satisfying the eligibility criteria of the petitioners. Under these circumstances, in view of this Court, it is appropriate to dispose of this Writ Petition without keeping pending for years together by issuing certain directions to the petitioners and the respondents to meet the ends of justice.

Accordingly, the Writ Petition is disposed of with the following directions:
i) The petitioners shall submit all the requisite documents to respondent No.6 to prove their entitlement under "YSR Cheyutha" scheme within a period of one week from today;
ii) Respondent No.6 shall verify the said documents and include the names of the petitioners in the beneficiaries list if they are fulfilled the eligibility criteria within one week thereafter;

iii) Respondent No.6 shall inform the reasons in writing to the concerned petitioner if her case is not considered under proper acknowledgment within one week thereafter;
iv) the remaining respondents are directed to make payments to the petitioners, who are included in the beneficiaries list by respondent No.6, within a period of four weeks from today.
There shall be no order as to costs.
Miscellaneous petitions pending, if any, in this case shall stand closed.
