Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the 3^rd respondent to issue Transit Permits as per the orders in Memo No.3252486/D10/2020 dated 27.05.2020 issued by the 2^nd respondent for removal/transport of remaining 2,35,981 MTs of inferior grade iron ore from the mine situated in Sy.No.865 of Veldurthy Village and Mandal, Kurnool District, pending disposal of WP No.19444 of 2020, on the file of the High Court.

The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and upon hearing the arguments of SRI VENKATESWARLU POSANI Advocate for the Petitioner and of GP FOR MINES AND GEOLOGY for the Respondents, the Court made the following ORDER:

"Heard Sri Posani Venkateswarlu, learned counsel for the petitioner and the learned Government Pleader for Mines and Geology appearing for the respondents. Perused the material available on record.

It is submitted by the learned counsel for the petitioner that inspite of the orders by the respondent No.2 in memo No.3252486/D10/2020, dated 27.05.2020 the respondent No.3 is not issuing transit permits for removal/transport of remaining 2,35,981 MTs of inferior grade iron ore from the mine situated in Sy.No.865 of Veldurthy Village and Mandal, Kurnool District.

It is submitted by the learned Government Pleader that the 3^rd respondent-Assistant Director sought clarification from the 2^nd respondent-The Director with regard to extension of six (6) months time after expiry of the lease period.

In the opinion of this Court, as and when the respondent No.2, the Director of Mines and Geology, who is the superior officer to the respondent No.3-The Assistant Director granted extension of six (6) months period, it is not proper and reasonable for not considering the case of the petitioner for granting to issue transit permits.

In view of the above, there shall be an interim direction to the respondent No.3 as prayed for."
