Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the proceedings in R.Dis.F1/317957/2020, dated 21-07-2021 issued by the respondent No.2 in rejecting to delete the land belong to the petitioner in an extant of Ac.2.82 Cents in Sy.No.269/5 of Thottambedu Village and Mandal, Chittoor District, assigned under political sufferers quota to the assignee from the prohibitory lands list stating that the same was not sold prior to 10 years of assignment and the consequential action of the respondent No.4 in refusing to receive and register a Sale Deed for the same as arbitrary, illegal, colorable exercise of power, contrary to the G.O.Ms.No.1743, dated 28-08-1959 and well established legal position apart from being violative of the fundamental and Constitution Rights guaranteed to the petitioner under Articles 14, 19, 21 and 300-A of the Constitution of India and consequently set aside the same by directing the respondents No.2 to delete the land in an extant of Ac.2.82 Cents in Sy.No.269/5 of Thottambedu Village and Mandal, Chittoor District from prohibitory lands list issued by him under section 22-A of registration Act, 1908

Petition under Section 151CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to suspend proceedings in R.Dis.F1/317957/2020, dated 21-07-2021 issued by the respondent No.2 by the directing the respondent No.4 to entertain the Sale Deeds for registration for the land extent of Ac.2.82 Cents in Sy.No.269/5 of Thottambedu Village and Mandal, Chittoor District without referring to prohibitory lands list issued by the respondent No.2, pending disposal of the above writ petition, Pending disposal of WP 17246 of 2021, on the file of the High Court.
The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and the Order of High Court dt; 16.8.2021 and upon hearing the arguments of M/s S PARINEETA Advocate for the Petitioner and GP FOR REVENUE Advocate for the Respondent(s) the Court made the following.
