Petition under Section 438 of Cr.P.C, praying that in the circumstances stated in the memorandum of grounds filed in Criminal Petition, the High Court may be pleased to enlarge the petitioner on anticipatory bail in the event of his arrest in connection with FIR No 213/2021 registered U/s 420, 468 IPC on the file of Owk Police Station, Owk, Kurnool District.

The petition coming on for hearing, upon perusing the Petition and the memorandum of grounds filed in support thereof and upon hearing the arguments of M/s.P V V Satyanarayana, Advocate for the Petitioner and the Assistant Public Prosecutor for the Respondent, the Court made the following; ORDER:

"Learned counsel for the petitioner submits that the petitioner was arrested on 08.08.2021 and remanded to judicial custody on 12.08.2021 and on that day the learned Magistrate has refused the remand report. Inspite of refusal by the learned Magistrate, the petitioner was in custody and when the matter came up before the Court on 16.08.2021, the petitioner was remanded to judicial custody on the same day and later the matter was adjourned to 17.08.2021.

Learned Assistant Public Prosecutor on instructions, submitted that the petitioner was arrested only on 16.08.2021 and on the same day he was remanded.

For further instructions, the matter was posted to today. Today, learned counsel for the petitioner has placed remand report dated 12.08.2021 before this Court which was refused by Magistrate and second remand report was accepted on 16.08.2021.

The concerned investigating officer i.e. Sub Inspector of Police, Owk Police Station, Kurnool District is directed to appear before this Court on 24.08.2021.

Post on 24.08.2021."
