ORDER:

This writ petition is filed with the following prayer:

"…declaring the action of the 2nd respondent in not disposing of the appeal filed by the petitioner on 14.03.2019 for cancellation of the D form pattas granted in favour of the respondents 4 and 5 over an extent of Ac.10.00 cents in Sy.No.72/2 and 71/2 situated in Surampalem Village, Rajavommangi Mandal, East Godavari District, as illegal and arbitrary."

Case of the petitioner is that, he is having ancestral property admeasuring an extent of Ac.10.00 cents in Sy.No.72/2 and 71/2 situated in Surmpalem village; the 3rd respondent has granted D form pattas in favour of respondents 4 and 5 during the year 2016 in respect of the subject land without any notice whatsoever to the petitioner; aggrieved by the same, petitioner filed an appeal before the 2nd respondent on 14.03.2019 and the 2nd respondent has not taken up the appeal. Hence, the present writ petition.

As seen from the averments of the writ affidavit, the appeal filed by the petitioner before the 2nd respondent is not yet numbered. In view of the facts and circumstances of the case, the 2nd respondent is directed to take up the appeal filed by the petitioner on 14.03.2019 and dispose of the same, as expeditiously as possible.

The writ petition is, accordingly, disposed of. No order as to costs. Miscellaneous petitions, if any, pending in the writ petition shall stand closed.
