before the Court in only 24 cases the petitioners received total amount and in all remaining cases either payments are not made or in some cases payments are made to an extent of only 79% by withholding 21% of the amounts payable to the petitioner. Finally, they stated that the respondent authorities are not making payments to the petitioner by following the order of the Court.

On the other hand, the learned Government Pleader for Panchayat Raj submitted that in cases where vigilance report is there against the petitioners, the respondents are not making any payment to them for taking further action basing on the vigilance report.

Learned Government Pleader further submits that in view the enquiry pending in some cases 20% of the amount they are withholding and remaining 80% amount is being paid to some of the petitioners.

Learned counsel appearing for the petitioners disputed the said contention of the learned Government Pleader saying that if there is any enquiry initiated/pending/conducting against the petitioners, the petitioners are entitled for notices against the said alleged enquiry. Till date there is no such information from the respondents that the enquiry is pending/going on against any of the petitioner. As such, this Court is not accepting the submission of the learned Government Pleader on this aspect for withholding 20% or 21% of the amounts payable to the petitioner on the ground of pendency of enquiries.

It is also brought to the notice of the Court by some of the learned counsel for the petitioners that in some cases the Government is transferring amount to the account of the Gram Panchayats and the Sarpanchs of Gram Panchayats are not releasing the payments in favour of the petitioners for the reasons best known to them.

Having heard all the submissions of the respective counsel appearing for either side, in the considered opinion of the Court, the Court is not concerned about all other issues which are unconnected to the implementation of the order of the Court. The only thing this Court wants to know from the respondents is that the payments are made or not to the petitioners in compliance of the order of the Court within the stipulated period. If the payments are not made to the petitioners within the stipulated period, the Court will take serious note of that and pass appropriate orders against the concerned.
