Criminal Petition No.3653 of 2023

ORDER:

Accused No.1 in Cr.No.26 of 2023 of Maharanipeta Police Station, Visakhapatnam District, which was registered for the offences under Sections 20(b)(ii)(C) read with 8(c) of Narcotic Drugs and Psychotropic Substances Act, 1985, filed the present application under Sections 437 and 439 of Criminal Procedure Code, 1973, seeking to enlarge him on bail.

2. Case of the prosecution is that, on 10.04.2023, at about 7.30 a.m., the Sub-Inspector of Police, Maharanipeta PS, along with his staff and mediators went to Simhadri Hospital, Krishna Nagar, Maharanipeta, Visakhapatnam City and found Accused Nos.1 to 4 in possession of 22 kgs of ganja. After conducting panchanama, the contraband was seized from the possession of the accused in the presence of mediators and thereafter, they were remanded to judicial custody.

3. Heard both sides and perused the record.

4. Learned counsel for the petitioner submits that the petitioner was arrested on 10.04.2023 and the contraband seized from him is 22 kgs, which is just above the commercial quantity. It is further submitted that the petitioner is in judicial custody from 10.04.2023, he requested this Court to enlarge the petitioner on bail.

5. On the other hand, learned Special Assistant Public Prosecutor on instructions submits that the petitioner also involved in another similar crime, which was registered as Cr.No.57/2017 of Jami PS, in which 850 Kgs of ganja was seized.

6. In that view of the matter, as the petitioner involved in another similar crime, in which 850 Kgs of ganja was seized, this Court is not inclined to grant bail to the petitioner/A.1.

7. Accordingly, the Criminal Petition is, dismissed.
