THE HON'BLE Dr. JUSTICE K. MANMADHA RAO CRIMINAL PETITION NO.3750 of 2022

ORDER:-

This petition is filed under Section 438 of the Code of Criminal Procedure, 1973, to enlarge the petitioner on bail in the event of his arrest.

  1. The petitioner is A-2 in Crime No.522 of 2022 of Special Enforcement Bureau Station, Rajamahendravaram South, East Godavari District.

  2. A case under Section 7(B) read with 8(B) of A.P. Prohibition (Amended) Act, 2020 was registered against the petitioner in the above crime.

  3. Heard learned counsel for the petitioner and the learned Additional Public Prosecutor for the State.

  4. Learned counsel for the petitioner would submit that the petitioner is falsely implicated in this case and no contraband is seized from the possession of the petitioner at the scene of offence and only basing on the confession of arrested accused, the petitioner is shown as accused. Hence, he would pray for grant of anticipatory bail to the petitioner.

  5. Learned Additional Public Prosecutor opposed the criminal petition and would submit that petitioner is a habitual offender and he involved in other similar offences, as such, the petitioner is not entitled to anticipatory bail at this stage.

  6. In view of the submission made by learned Additional Public Prosecutor as the petitioner is habitual offender, this Court is not inclined to grant pre-arrest bail to the petitioner. However, the petitioner is directed to surrender before the concerned jurisdictional Court and move an appropriate application seeking bail. On such surrender, the application moved by the petitioner shall be considered on the same day, in accordance with law.

  7. Accordingly, this Criminal Petition is disposed of.

Consequently, miscellaneous applications pending, if any, shall stand closed.
