SMT JUSTICE T. RAJANI

WRIT PETITION No.11105 of 2019

ORDER:

This writ petition is filed, under Article 226 of the Constitution of India, seeking to declare the action of the 3rd respondent in not considering the representation of the petitioner, dated 10.05.2019 and settling the accounts of the petitioner in accordance with the procedure contained in Article 22.1.2 contained in the lease agreement No.RLDA/2014/LA/2005, dated 30.12.2014, wherein the general conditions (GCLA), dated 26.03.2004 are incorporated, as illegal.

  1. Heard learned counsel for the petitioner and learned Standing Counsel for Railways appearing for respondents 1 to 3.

  2. Learned counsel for petitioner submits that with regard to the settling of the accounts of the petitioner in accordance with the procedure contained in Article 22.1.2 of the lease Agreement No.RLDA/2014/LA/2005, dated 30.12.2014, wherein the conditions of lease agreement, dated 26.03.2004 were incorporated, the petitioner gave representations to the 3rd respondent, dated 10.05.2019 & 01.07.2019, but the same are kept pending, without passing any orders.

  3. Hence, in view of the above, this Court deems it fit to direct the 3rd respondent to consider the representations of the petitioner, dated 10.05.2019 & 01.07.2019 and pass

appropriate orders within six (6) weeks from the date of receipt of a copy of this Order.

  1. With the above direction, the writ petition is disposed of. There shall be no order as to costs.

As a sequel, miscellaneous petitions pending, if any, in the writ petition shall stand closed.
